Baldwin Public Library Privacy Policy

Confidentially of Patrons:    See attached Michigan Act 455

Resolved, that library records and patron information are confidential. Library records are defined by MCL 397.602 are "a document, record, or other method of storing information retained by a library that contains information that personally identifies a library patron, including the patron's name, address the telephone number, or that identifies a person as having requested or obtained specific materials from the library" in any form that is maintained by the Library and that contains any of the following types of information:

Information an individual is required to provide in order to be eligible to use Library services or borrow materials.

Information that identifies an individual as having requested or obtained specific materials or materials on a specific subject.

Information that is provided by an individual to assist a staff member to answer a specific question or provide information on a particular subject.

Information that does not identify an individual and that is retained for the purpose of studying or evaluation the use of the Library is not considered confidential and is not subject to this policy.

Resolved, that no employee of the Baldwin Public Library shall make available any circulation records or patron records of The Baldwin Public Library to anyone including any agency or state, federal, or local government except pursuant to such process, order or subpoena as may be authorized under the authority of, and pursuant to, federal, state, or local law relating to civil, criminal, or administrative discovery procedures or legislative investigatory power.

RESOLVED, that in the event a written request, demand, order, subpoena, is made upon Baldwin Public Library or any of its employees to produce any such information such matter shall immediately be brought to the attention of the Director and the matter shall be turned over to legal counsel for the City of Birmingham for advice.
